1. Our Commitment to Intellectual Property

AI Images Upscaler (Unlimited) ("we", "our", or "us") respects the intellectual property rights of others and expects users of our Service to do the same. This Digital Millennium Copyright Act ("DMCA") Policy explains how copyright owners can report alleged infringement and how we respond to valid notices, in accordance with 17 U.S.C. § 512.

2. Scope of This Policy

Our Service allows users to upload images for the sole purpose of AI-powered upscaling and enhancement. Users are solely responsible for ensuring they hold the necessary rights, licenses, or permissions to upload and process any image submitted to the Service. We do not host, browse, or publish user-uploaded images as public content; images are processed and made available for download by the uploading user only.

3. Filing a DMCA Takedown Notice

If you believe that content processed, stored, or made accessible through our Service infringes your copyright, you may submit a written notice containing the following information:

  • A physical or electronic signature of the copyright owner or an authorized agent.
  • Identification of the copyrighted work claimed to have been infringed.
  • Identification of the material claimed to be infringing, with enough detail (such as a job ID, URL, or description) to allow us to locate it.
  • Your contact information, including name, address, telephone number, and email address.
  • A statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
  • A statement, made under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on their behalf.

Notices should be sent to our designated agent at ai.images.upscaler@gmail.com with the subject line "DMCA Takedown Notice."

4. Our Response to Valid Notices

Upon receipt of a complete and valid notice, we will act expeditiously to review the claim, remove or disable access to the identified material where appropriate, and notify the user who submitted the material. We reserve the right to reject incomplete or clearly abusive notices.

5. Counter-Notification

If you believe your material was removed or disabled by mistake or misidentification, you may submit a counter-notification containing:

  • Your physical or electronic signature.
  • Identification of the material removed and its location before removal.
  • A statement, under penalty of perjury, that you have a good-faith belief the material was removed as a result of mistake or misidentification.
  • Your name, address, telephone number, and a statement consenting to the jurisdiction of the applicable federal court.

Upon receipt of a valid counter-notification, we may restore the removed material after the timeframe required by applicable law, unless the original complainant files for a court order restraining the alleged infringer.

6. Repeat Infringer Policy

In accordance with the DMCA and other applicable law, we maintain a policy of terminating, in appropriate circumstances, the accounts of users who are determined to be repeat infringers.

7. False Claims Warning

Under Section 512(f) of the DMCA, any person who knowingly makes a material misrepresentation in a takedown notice or counter-notification may be liable for damages, including costs and attorneys' fees. Please ensure any notice you submit is accurate and made in good faith.

8. Changes to This Policy

We may update this DMCA Policy from time to time. Updates will be posted on this page with a revised "Last updated" date.
